温州住宅建设用地使用权续期收费的案例暴露了我国相关法律之间的矛盾,这种矛盾是由于宪法在分配权力的时候界限不清导致的,《物权法》的“自动续期”是对公民住宅权保障的呼唤,而现有的法律则是管理视角。要解决这个问题,需要明确公私法的分权,并从宪法层面去解决。
The case of renewal fees for the right to use residential land for construction in Wenzhou exposed the contradictions between the relevant laws in our country.
