2001年10月27日修正的著作权法在我国首次确立了作品出租权制度,进一步完善了我国的著作权法律制度。研究著作权出租理论,比较国际条约和各国出租权制度立法,对于完善著作权人的权利保护,协调著作权人与作品使用人之间的利害关系,并寻求解决该问题的最佳途径具有极为重要的现实意义。现代科学技术的发展,作品复制件出租业日渐繁荣,由此也带来了一系列的问题,因此有必要对这一新的作品使用方式进行剖析。文章从出租权的概念入手,对出租权主体和客体进行了探讨,并就此指出了著作出租权的不完善之处和建议。
The Copyright Law, amended on October 27, 2001, established the system of leasehold rights for the first time in our country and further perfected our copyright law system. Studying the theory of copyright rent and comparing the international treaties with the legislation of the system of rent rights in different countries have the extremely important realities for perfecting the rights protection of the copyright owners, coordinating the interests between the copyright owners and the users of the works, and finding the best way to solve the problems significance. With the development of modern science and technology and the increasingly prosperous rental of duplicate works, a series of problems have also arisen. Therefore, it is necessary to analyze the use of this new work. Starting from the concept of rent right, the article discusses the subject and object of rent right, and points out the imperfection and suggestion of rent right.
