北京市工商行政管理局、北京市建设委员会所制定和颁布的《北京市商品房认购书》(以下称“认购书”)、《北京市商品房预售合同》(以下称“预售合同”)的示范文本将于2005年3月15日在北京市正式推行使用了。认购书作为示范文本的首次制定使用以及预售合同中新的补充和修改规定,既能起到有效减少和解决房地产买卖、交易纠纷的作用,也能有效地规范房地产市场秩序,从而进一步推动房地产市场和行业更加健康地发展。同时,笔者作为多年担任房地产开发企业的常年法律顾问的专业律师,就认购书、预售合同尚需补充和完善的主要事项,提出个人的如下建议,以期与各位读者交流、探讨。
