与《担保法》及其解释相比,《物权法》担保物权编实现了对《担保法》的革命性突破,突出表现在:担保物权的实现方式的改变,即无需诉讼直接进入执行程序拍卖、变卖担保物以实现担保物权。《物权法》关于担保物权的非讼实现方式侧重于简化诉讼程序、降低执行成本、提高交易效率,对传统的民事执行方式和执行理念产生了重大影响。但《民事诉讼法》缺乏程序保障,致使担保物权的非讼实现方式“有名无实”。因此,现阶段如何建构担保物权非讼执行程序,通过非讼方式实现担保物权是当务之急,也是本文重点研讨内容。

Therefore, at this stage, how to construct the non-compliance enforcement procedures of security interest and to realize security interests through non-litigation is the top priority of this paper, and also the key content of this article.
