面对复杂而繁重的法院案件,西方发达法治国家推行了或正在推行着一系列的司法改革和民事诉讼的制度改革,普遍存在着在民事诉讼中强化法官职权、弱化当事人自主性和主导性的倾向。法官开始尝试采用某些管理技术,运用他们作为法官的角色来推动案件和解,将案件导向调解或其他替代性的纠纷解决方案,本文探讨了美国管理型法官这种新型司法管理理念的崛起缘由,并从诉讼的核心中立性价值及效率问题两个方面透视了其受到的毁誉参半的评价。

Judges begin to try certain management techniques, use them as judges to promote case reconciliation, and lead cases to conciliation or other alternative dispute resolution programs. This article explores the rise of the new concept of executive juridical management in the United States, And from the two aspects of litigation’s core neutrality value and efficiency, it also appraises its evaluation of mixed reputation.
