裁判文书的事实认定与裁判者对证据的采信密切相关,据以认定的证据组成的链条构造了案件事实的全貌,案件事实是裁判结论形成过程中不可或缺的部分。裁判文书体现了证据采信的过程,使得裁判者认定的事实更具客观依据,同时最大程度地全面还原了庭审过程,使文书受众清晰地了解庭审信息。本文以美国民事判决书事实认定模式为比较样本,剖析我国民事审判体系中关于事实认定的现有模式,提出改进我国裁判文书模式的建设性意见。
The fact cognizance of the verdict documents is closely related to the admissibility of the evidence by the referees. According to the evidence, the chain of evidence constitutes the whole picture of the facts of the case. The fact of the case is an indispensable part of the formation of the verdict conclusion. The referee instruments reflect the process of evidence collection and acceptance, which makes the fact that the referee finds more objective basis. At the same time, the hearing process of the referee is restored to the maximum extent so that the clerical audience can clearly understand the trial information. This article uses the factual identification mode of American civil judgments as a comparative sample to analyze the existing mode of cognizance of fact in our civil trial system and to put forward constructive suggestions to improve the mode of our country's verdict documents.
