一、当前集体劳动争议的现状在社会主义市场经济条件下,企业通过深化劳动、工资和社会保险制度改革,调动了广大职工的生产积极性,增强了企业活力。但是,改革要对旧有的利益关系进行新的调整,必然牵扯到一部分职工的切身利益,在现有的政策和措施不配套,法制建设不完善的情况下,企业集体劳动争议的产生是不可避免的。从全国各地受理的集体劳动争议案件分析,这些争议具有以下四个特点。 1.案件数量明显增多。据青岛地区统计,1993年发生的集体劳动争议案件比1992年增长了44%。 2.争议焦点由行政管理转向物质利益分配。多数争议都是围绕着工资、奖金分配、劳动福利待遇、养老保险和履行劳动合同发生的。

Current Situation of Collective Labor Disputes In the socialist market economy, enterprises have mobilized their enthusiasm for production and deepened their vitality through deepening labor, wage and social security reforms. Under the circumstances that existing policies and measures are not adequate and the legal system is not perfect, the emergence of collective labor disputes in enterprises is inevitable Avoided. The analysis of collective labor dispute cases accepted from all over the country shows that these disputes have the following four characteristics. 1. The number of cases has increased significantly. According to the statistics of Qingdao, the number of collective labor disputes that occurred in 1993 increased by 44% over 1992. 2. The focus of controversy shifted from administration to the distribution of material benefits. Most controversies revolve around wages, bonus distribution, benefits to work, endowment insurance, and performance of labor contracts.
