《中华人民共和国学位条例》第十七条规定:“学位授予单位对于已经授予的学位,如发现有舞弊作伪等严重违反本条例规定的情况,经学位评定委员会复议,可以撤销。”学位证书是对被授予人专业资格或技能的认可,对于以舞弊作伪的方式取得的学位破坏了国家的学位制度,会给社会造成不良的影响,必须予以撤销。学位撤销权作为一种行政权力,像其他任何权力一样容易自我扩张,所以,必须对其进行规制。本文根据有关的行政法原理和行政法的基本原则,结合陈颖诉中山大学案件的分析,认为学位撤销权应受到以下几个方面的限制:第一,撤销学位应符合依法行政原则的要求;第二,撤销学位应符合信赖保护原则的要求;第三,撤销学位应符合法的安定性原则的要求;第四,撤销学位应符合正当程序原则的要求。
Article 17 of the Regulations of the People’s Republic of China on the Regulations on the Degree of the People’s Republic of China stipulates: “The degree-awarding institution may, with the degree conferring a degree conferred, seriously disobey the provisions of these Regulations and may be withdrawn if it is reconsidered by the degree assessment committee.” A certificate is a recognition of a person’s professional qualifications or skills. A degree obtained by fraud or fraud undermines the country’s degree system and will have an adverse impact on the society and must be rescinded. As an administrative power, degree rescission is as easy to self-expand as any other power, so it must be regulated. According to the principles of administrative law and administrative law, combined with the case analysis of Chen Ying v. Sun Yat - sen University, this paper argues that the right of withdrawal of a degree should be restricted in the following aspects: First, the degree of revocation should meet the requirements of the principle of administration according to law; Second, the degree of revocation should meet the requirements of the principle of trust protection. Third, the degree of revocation should meet the requirements of the law of stability. Fourth, the degree of revocation should meet the requirements of the principle of due process.
