和解作为一种解决纠纷的方式,由于其在具体规定上的不完善,常常被人们所忽视。而和解制度在我国有着深厚的文化背景,如能充分利用和解制度的优点,将会在解决纠纷特别是在少数民族的婚姻家庭纠纷中发挥比其他解纷方式更优越的作用。本文从和解的历史沿革、运用的必要性方面来引起人们对和解制度的关注,重点论述了和解在解决婚姻家庭纠纷中的优越性。
As a solution to disputes, reconciliation is often overlooked because of its imperfect specific provisions. The reconciliation system has a profound cultural background in our country. Taking full advantage of the reconciliation system will play a superior role in settling disputes, especially in disputes among ethnic minorities in marriage and family. This article draws attention to the reconciliation system from the historical evolution of the reconciliation and the necessity of its application. It focuses on the superiority of reconciliation in settling marital disputes.
