宪法规定了检察机关独立行使检察权,但由于当前存在着检察机关机构设置行政化、办案程序行政化、队伍管理行政化等体制的弊端,造成了检察机关不能完全依法、有效、独立地行使检察权。因此改革检察机关现行的管理体制,促进检察权转型,完善检察权的配置、行使和监督,是保证检察权正确独立行使,维护司法公正的必经之路。
