随着国际航运技术的发展,现已生效的国际航运公约远远落后于时代,无法完整地调整国际货物运输领域出现的法律关系,新的公约呼之欲出。《鹿特丹规则》的出现正是顺应了这种需要,毋庸置疑这是国际航运界的一项重大事件,一旦生效将带来整个国际货物运输领域的革命。本人通过同在国际海运领域已经生效的三大公约进行比较,分析《鹿特丹规则》中对于承运人责任的具体规定的变化,并对我国《海商法》的应对之策提出自己的见解。
With the development of international shipping technology, the existing international shipping convention lags far behind the times and can not completely adjust the legal relationship that emerged in the field of international freight transportation. The new convention is ready to come out. The emergence of the Rotterdam Rules is a response to this need. There is no doubt that this is a major event for the international shipping community, and once it enters into force, it will bring about revolution in the entire field of international freight transport. By comparing with the three conventions that have entered into force in the field of international maritime transport, I analyze the changes of the specific provisions of the Rotterdam Rules on the responsibility of the carrier and put forward my own opinions on the measures to deal with the “Maritime Law of Our Country.”
