随着市场经济的发展,产品的包装装潢不再是简单意义上的“漂亮”而已,它已逐渐发展成为了企业间竞争的重要手段和有效途径。但目前我国包装装潢的权益还没有单独作为一项权利来进行明确的界定和保护。本文通过对我国包装装潢知识产权保护现状的研究,分析不同知识产权特别法的重叠保护引起的权利冲突,从而提出了对包装装潢保护采用以商标法保护模式为主的方案。
With the development of market economy, packaging and decorating of products is no longer “beautiful” in a simple sense. It has gradually developed into an important means and an effective way of competition among enterprises. However, at present, the rights and interests of China’s packaging and decorating have not been separately defined and protected as a right. Through the research on the present situation of intellectual property protection in China, this paper analyzes the conflicts of rights caused by the overlapping protection of the special law of different intellectual property rights, and puts forward the proposal of adopting the trademark protection mode as the protection of packaging and decoration.
