本论文的主要目的,在于呈现国际法方法论的基本架构。国际法方法论的范畴包含下列数个议题:(一)成文条约的解释与续造;(二)不成文国际法法源内涵的认定;(三)事实认定。国际法方法论的建构,可以从下列三个方向为之:(一)从学说、判例及实践中归纳出一些原则;(二)把国内法方法论的原则移植入国际法方法论领域;(三)把(一)及(二)的原则予以系统化及给予理论的基础。
The main purpose of this paper is to present the basic structure of the methodology of international law. The category of methodology in international law contains the following topics: (1) the interpretation and renewal of written treaties; (2) the determination of the meaning of the source of unwritten international law; and (3) the determination of facts. The construction of the methodology of international law can be done in the following three directions: (1) to summarize some principles from doctrine, precedents and practice; (2) to transpose the principle of the methodology of domestic law into the methodology of international law; (3) ) And (b) of the principles to be systematized and given the theoretical basis.
