票据法对票据抗辩进行限制的理论基础建立于票据的流通性的要求、票据的无因性和独立性、以及票据的权利外观主义。本文在票据抗辩限制只限于人的抗辩前提下,对几种错误归类于物的抗辩中的情形进行了抗辩限制分析;最后分析了抗辩限制的两个例外,并分别提出应该注意的关键问题。
The theoretical basis of the Law of Negotiable Instruments, which limits the countermeasures of negotiable instruments, is based on the requirement of the negotiability of negotiable instruments, the non-consensual and independence of negotiable instruments and the right-externality of negotiable instruments. In this paper, under the precondition of the counter-limitation of the counterfeit being confined to the human one, several countermeasures and defenses of the misclassification of counterfeits are carried out. Finally, the two exceptions to the defensive limitation are analyzed and the key issues that should be paid attention are respectively raised .
