宪法是国之根本大法,与民主的发展密切相关。2017年4月6日,泰皇拉玛十世在曼谷王朝开国纪念日颁布实施泰国第20部新宪法。新宪法全部条文279条,重要内容是反腐和改革国家各方面,如政治、行政、法律、司法程序和教育等。在新宪法当中,巴育领导的维持和平与秩序委员会第44条特别权力将仍然有效直至新政府上台执政。这意味着现任总理巴育将带领军方集团继续管理泰国。本文试从泰国颁布的新宪法入手,从对泰国国内的政党治理、为即将到来的泰国大选铺路和走向军方期待的泰式民主三个方面探讨该事件对泰国民主政治的影响。
The Constitution is the fundamental law of our country and is closely related to the development of democracy. On April 6, 2017, Thai King Rama X promulgated the twentieth new constitution of Thailand on the anniversary of founding of Bangkok dynasty. Article 279 of the new constitution contains an important part of combating corruption and reforming all aspects of the country, such as politics, administration, law, judicial procedures and education. In the new constitution, Article 44 of the Committee on Peacekeeping and Order led by Baghdou will remain in force until the new government takes power. This means that the current Prime Minister Baal will lead the military group to continue to manage Thailand. This article tries to start with the new constitution promulgated by Thailand and discusses the impact of the incident on Thai democracy from three aspects: governing the political parties in Thailand, paving the way for the upcoming Thai general election and stepping forward to the military’s desire for Thai democracy.
