土地法律法规混乱、模糊,多部门交叉管理及调解登记纠纷组织缺失等问题严重。国土资源部应尽快出台《不动产权属争议处理条例》明确土地承包经营权主体,规范权属争议。土地承包经营权的权利主体应当是农户,但要进行法人化改造。土地承包经营权应当采用登记要件主义模式,建立多层次的纠纷解决机制。设立不动产登记局,远期应设立民商事登记局。完善法律以解决《不动产登记暂行条例》与上位法的冲突。土地经营权应以用益物权进行保护,试点地区“三权三证”应同时进行。
