审理行政诉讼案件的情况与特点自1990年行政诉讼法实施以来,北京市各级法院圆满地审理了一批行政案件。据北京市高级人民法院的统计数字表明:1990年至2000年的10年间,北京市各级法院共受理行政诉讼案件4630件,平均年增长幅度为25％。结案4541件。行政案件的年收案数在全国排序第10位。案件类型已达到近60种,涉及中央直属机关近30个部门。在已审结的4541件中,维持行政机关具体行政行为的1349件,撤销行政机关具体行政行为的400余件,加上变更撤诉的案件,被告在行政诉讼中的败诉率为
The Situation and Characteristics of Administrative Litigation Cases Since the implementation of the Administrative Procedure Law in 1990, all levels of courts in Beijing have satisfactorily heard a number of administrative cases. Statistics from the Beijing Higher People’s Court show that in the 10 years from 1990 to 2000, 4630 administrative litigation cases were handled by courts in Beijing at all levels, with an average annual increase of 25%. 4541 cases closed.
