在中国特色社会主义法律体系基本形成的新形势下,我国的立法工作从注重制定新法的形成阶段已经进入立、改、废、释并重的完善阶段。正如邦国委员长指出的,“建设中国特色社会主义是一项长期的历史任务,完善中国特色社会主义法律体系也是一项长期的历史任务,必须随着中国特色社会主义实践的发展而发展”。而构建立法与执法良性互动关系,则是完善中国特色社会主义法律体系不可忽视的基础性工作。笔者目前在基层调研中着重对已制定地方性法规的实施进行了粗浅的考察,发现如下几则案例,颇值得回味:一 Under the new situation in which the legal system of socialism with Chinese characteristics has basically taken shape, the legislative work in our country has entered the stage of perfection of establishing, reformulating, invalidating and releasing the law from the stage of focusing on the formulation of a new law. As stated by the chairman of the State Council, “building socialism with Chinese characteristics is a long-term historic task. Improving the socialist legal system with Chinese characteristics is also a long-term historic task that must develop with the development of socialism with Chinese characteristics.” ". Constructing the benign interaction between legislation and law enforcement is a basic work that can not be ignored in improving the socialist legal system with Chinese characteristics. At present, the author mainly studies the implementation of local laws and regulations that have been formulated in the grass-roots investigation and makes a superficial investigation.
