This article explores the scope of application of the performance bond in Section 4.2 [Performance bond] of FIDIC conditions of construction and section 15.2 [Termination of employer] by combing a dispute between the bank (as a guarantor) and the employer. Through the Court of Appeal’s judgment on the bank’s claim, the court interprets the court’s understanding of the scope of summary judgment and interprets the issue of unliquidated claims under the L / C of letters of credit, so as to ensure that future contractors, employers and third-party agencies will fulfill their contractual obligations And to protect their own rights and provide reference.
