量刑调查制度是现代量刑制度的重要组成部分,对于促进刑罚个别化和量刑公正的实现意义重大。我国目前正在推行量刑规范化改革,但由于量刑调查制度的欠缺和滞后,影响着改革的效果,亟须在中国构建系统、规范的量刑调查制度,这是保障量刑公正的必由之路。应当从制度名称、调查方法、调查内容、调查报告的法律属性及适用程序等方面,对量刑调查制度加以规范和建构。
Sentencing investigation system is an important part of modern sentencing system, which is of great significance to promote the individualization of sentencing and the realization of sentencing fairness. At present, the standardization of sentencing reform is being implemented in our country. However, due to the lack and lag of sentencing investigation system, which affects the effect of the reform, it is imperative to construct a systematic and standardized sentencing investigation system in China. This is the only way to guarantee sentencing justice. The system of measurement of sentencing shall be regulated and constructed from the aspects of system name, investigation method, contents of investigation, legal attributes of investigation reports and applicable procedures.
