每一个独立的法律部门都需要一个完备科学的法律体系作为支撑,以奠定学科进步发展的基础,经济法也不例外。然而,我国目前的经济法体系没有形成统一的定论,处于比较混乱的状态。要建立真正科学完备的经济法体系,我们就应该从实际出发,从实然的角度分析经济法在现实经济生活的整个过程中是如何发挥作用的,以国家宏观调控为中心,围绕国家在调控市场主体存在、调控市场主体进入市场、调控市场主体经营行为调控市场结构、调控市场主体经营成果分配等方面发挥的作用来抽象应然的经济法体系。这样构建经济法体系的好处在于其外部渐次深入,前后呼应;其内部逻辑清晰,上下一体,能构成贯穿全学科的分析框架。
