不能抗拒的原因,是指人在不能抗拒的力量支配下不得已而实施的可以免罪的行为。不能抗拒的对象包括自然因素、社会因素、他人行为、自身因素等。不能抗拒的原因的本质是行为人缺乏自由意志。判断行为人是否具有自由意志,应考虑主体条件、强制力量的大小、制度环境等多种因素。不能抗拒的原因是故意和过失的前提。不能抗拒的原因之所以可以免罪,是因为行为人不具有构成犯罪所需的主观恶性和人身危险性。
The reason that can not be resisted refers to the act of impunity that a person can not but exert under the control of irresistible forces. The irresistible objects include natural factors, social factors, others’ behaviors, and other factors. The essence of the irresistible cause is the lack of free will of the perpetrator.
