行政听证程序是行政程序法的核心内容,但目前我国行政听证制度在适用范围、听证主持人、听证笔录的效力、听证程序的监督和救济机制方面存在一些问题。完善的对策在于:扩大行政听证的适用范围;建立健全的听证主持人制度;完善案卷排他性原则,明确听证笔录的法律效力;建立行政听证程序的监督和救济制度。 The administrative hearing procedure is the core content of the administrative procedure law. However, there are some problems in the scope of application, the effectiveness of the hearing presenter, the transcript of the hearing, the supervision and relief mechanism of the hearing procedure. The perfect countermeasures are as follows: expanding the scope of administrative hearing; establishing a sound system of hearing presenters; perfecting the principle of exclusiveness of the case files, clarifying the legal effect of the transcripts of the hearing; and establishing the supervision and relief system of administrative hearing procedures.
