刑事被害人国家补偿制度是国家在一定范围内对因遭受特定犯罪损害又无法通过刑事附带民事诉讼或其他途径获得赔偿而陷入严重生活困境的被害人及其家属,通过法律程序对其所遭受的物质损失给予一定的经济补偿,使被害方利益在一定程度上得以恢复的制度。构建我国刑事被害人国家补偿制度,必须在补偿对象、补偿条件、补偿资金、补偿程序和补偿限制等方面进行深入、具体的设计,确保制度实施的操作性和实用性,发挥国家补偿制度真正效用。
