农村征地补偿协议因法律冲突或立法空白导致制度绩效低下,检审征地补偿协议的立法定位和法律性质是完善征地补偿协议法律管制的前置条件。本文分别讨论了征地补偿协议的内涵和性质、订立规制及法律救济等问题,提出完善农村征地协议的相关内容和程序以及救济途径,强调通过立法完善和管制提升,以契约形式构建包括政府和农民在内的多元主体的利益安排。
Due to legal conflicts or legislative gaps, the compensation agreement in rural areas leads to poor system performance.
