法官的自由裁量行为普遍地存在于司法过程之中,并深刻地影响着司法权的外观。规范法官自由裁量权是实现审慎司法的必经之路。本文即力图探究科学规范法官自由裁量权的方法与路径,以期帮助法官合理地运用手中的权力,令司法权力的运作保持其应有的审慎。
Judges’ discretionary acts generally exist in the judicial process and have a profound impact on the appearance of judicial power. Regulating judges’ discretion is the only way to realize prudent justice. This article attempts to explore the method and path of scientifically regulating judges’ discretion in order to help judges make reasonable use of the power in their hands so that the operation of judicial power can maintain its due cautiousness.
