针对《档案法》赋予档案行政管理部门的监督和指导职责,从法律法规和档案专业的角度,分析档案执法与业务指导的内涵及特征。同时,从内容、方式、资格、程序、效果等多方面挖掘二者之间的相同点与不同点,档案管理实际探讨档案执法与业务指导的关系。通过对两者的研究分析提出意见,以期为执法者和指导者更加明确自己的权利和义务,正确处理好二者的关系提供理论指导。
In accordance with the supervision and guidance given by the Archives Law to the administrative departments of archives, from the perspective of laws, regulations and archives, the connotation and characteristics of archives law enforcement and operational guidance are analyzed. At the same time, we should explore the similarities and differences between the two in contents, methods, qualifications, procedures, effects and so on, and file management actually explores the relationship between file law enforcement and business guidance. Through the research and analysis of the two, we put forward opinions to provide theoretic guidance for law enforcers and directors to clarify their rights and obligations more clearly and properly handle the relationship between the two.
