生态文明的制度建设是一个由根本制度、基本制度和具体制度组成的立体性多维构架。所谓具体制度是指根本制度和基本制度之下或与之相关的、或者机构实体化程度相对较低的体现与规范着人、社会与自然之间和谐共生目标以及相应的社会与个体行为要求的(社会主义)生态文明制度。比如耕地保护制度、水资源管理制度、资源有偿使用制度和生态补偿制度、节能减排相关制度、新能源开发激励制度、生态环境保护责任追究和环境损害赔
