单边贸易限制或禁止行动已为GATT体制原则废弃。WTO成员单边实施人权贸易措施引起了人们激辩人权措施与GATT例外条款的一致性问题。国家安全例外最易引发单边人权贸易措施的合理解释问题。协调、平衡此类措施与GATT例外条款的兼容关系需求助于条约的解释功能。
Unilateral trade restrictions or prohibitions have been abandoned for GATT institutional principles. The unilateral implementation of human rights measures by WTO members has raised the issue of consistency between the human rights measures and GATT exceptions. The exception of national security can most easily lead to the issue of reasonable interpretation of unilateral human rights trade measures. The need to coordinate and balance the compatibility of such measures with the GATT exception clauses contributes to the treaty interpretation function.
