为破解执行程序中的堰塞湖效应,最高人民法院《关于适用民事诉讼法的解释》第513条至第516条确立了执行与破产的对接程序,从而使我国破产程序的启动由单纯的申请主义转变为申请主义之下职权辅助的模式。申请主义之下的职权辅助模式应为公权力的合理介入,释明权、建议权的规则在于控制执行转破产程序中法官自由裁量的限度。鉴于执行制度在现实层面已形成对破产制度的替代效应,应通过立法修改、社会资源的再平衡配置等方式鼓励社会对破产程序的利用,以实现对执行工作堰塞湖效应的源头治理。
In order to solve the barrier lake effect in the enforcement proceedings, articles 513 to 516 of the Interpretation of the Supreme People’s Court on the Application of Civil Procedure Law have established the procedure of connection between execution and bankruptcy so that the initiation of bankruptcy proceedings in our country will be changed from a mere application Doctrine into doctrine under the mode of functional assistance. The auxiliary mode of power under petition should be the reasonable intervention of public power. The rule of right of interpretation and suggestion of power lies in the limit of the discretion of the judge during the procedure of transfer to bankruptcy. In view of the fact that the enforcement system has formed an alternative effect on the bankruptcy system at the practical level, we should encourage the society to make use of bankruptcy procedures through legislative amendments and the re-balancing of social resources so as to achieve the source control of the dammed lake effect.
