诱导性询问,是指询问者为了获得某一回答而在所提问题中添加有暗示被询问者如何回答的内容,或者将需要被询问人作证的有争议的事实假定为业已存在的事实加以提问而进行的提问。依据询问者的主观意图不同和对证人控制幅度方面的不同,诱导性询问可以分为不同种类。诱导性询问规则是保证举证和质证有利于揭示案件真相而不是远离这些真相的一项重要规则。诱导性询问作为一种询问和质证的方式运用于美国司法审判中,在理论上和实践中具有一定的价值。
Inductive interrogation refers to the fact that the inquirer adds in the question to the question in order to obtain an answer what the questionee is saying or the fact that the controversial subject to be testified by the inquirer is presumed to be an existing fact Questions to ask.
