现实中因执行上级错误命令导致的渎职犯罪屡见不鲜,究其原因既有中国官场传统潜规则,也有现实利益的博弈,更有法制上的缺漏;如何处置此类犯罪,应遵循罪责相适应的原则,综合考量犯罪者的现实处境、犯罪情节和主观心态,罚当其罪,实现正义和公平;也应在法制设计上进一步完善下级对于上级的抗辩权内容,并实现程序保障;同时,需进一步完善公职人员尤其是领导干部的业绩考评体系,从上至下全面树立依法行政和以人为本的现代执政观。
