诉讼语言文字选择权是公民诉讼权利的一种,其并非是实现诉讼的直接的基本权利,而是由直接实现诉讼目的的一些基本权利所派生出来的权利。诉讼语言文字权的保护,不仅具有体现程序公正和保证诉讼权利的价值,而且能够促进民族团结和构建社会主义和谐社会具有重要作用。本文通过分析诉讼语言文字权的现状和存在问题,阐述诉讼语言文字权的法理依据,进而从建立以当事人直接程序参与为主,提供语言翻译为辅的诉讼语言环境,进一步完善法务翻译制度,在民族区域自治地方建立双语诉讼机制等三个方面提出了构建诉讼语言文字权的保障机制。
Litigation language and language choice is a kind of civil litigation right, which is not a direct and fundamental right to realize litigation but a right derived from some basic rights that directly realize the purpose of litigation. The protection of procedural language and language rights not only has the value of showing procedural fairness and guaranteeing litigation rights, but also can promote national unity and build a harmonious socialist society. Based on the analysis of the present situation and existing problems of litigation language and writing right, this article elaborates the legal basis of litigation language literal right, and further establishes the law translation system by establishing a procedural language environment supplemented by language translation with the direct participation of the parties involved. The establishment of a bilingual litigation mechanism in the autonomous regions of ethnic minorities, put forward the safeguard mechanism for the construction of language literacy rights in litigation.
