我国《物权法》对动产抵押公示效力统一规定为登记对抗原则。本文认为,在我国现行的大陆法系特色的民法体制中,动产抵押权的成立不宜适用登记对抗原则,因为,依目前的通说,所谓登记对抗,即指抵押权在抵押合同成立时即已设立,登记只是对抗第三人的要件,这不仅在理论上违反了我国物权法体系,在实践中也很难对未登记之抵押权进行救济从而使之丧失物权性,我国动产抵押权应采登记生效原则为宜,因为,动产抵押权的物权性是大陆法系的必然产物;物权行为现实存在使物权行为公示方式之立法不可或缺;登记生效是动产抵押权之物权性凸显的唯一选择。
