人民监督员制度是主权在民的体现,是人民检察机关解决自侦案件缺乏国家权力监督与专门监督的体现,尚处于试行阶段的制度存在较多的问题,主要体现在人民监督员监督的法律依据、性质、范围等方面,准确定位人民监督员制度需要科学的法理基础与明确的法律根据。
