对山西省2010-2012年财产刑执行情况的调查表明,财产刑执行中有判无执、执而不力的情况较为严重。财产刑执结率低与执法人员认识不到位、量刑法律规定模糊、执行机构不明确、程序缺失等问题密切相关。建议深入探索财产刑执行工作机制、完善执行相关问题的立法规范、加强检察机关对财产刑执行的监督。
A survey of the implementation of property punishments in Shanxi Province from 2010 to 2012 shows that the execution of property punishments is rather severe and the enforcement of punishments is more serious. The low rate of execution of property crimes is not closely related to the lack of awareness among law enforcement officials, the obscure legal provisions of sentencing, the uncertain implementation agencies and the lack of procedures. Proposals should be made to explore in-depth the implementation of the working mechanism of property punishments, improve the legislative norms for the implementation of relevant issues and strengthen the supervision over the enforcement of property punishments by procuratorial organs.
