《劳动合同法》及其配套法律法规中大量规定了企业给付劳动者金钱补偿/赔偿的情形,给付经济补偿金的情形最多。经济补偿金兼有违约补偿、失业保障、企业关怀、赔偿与惩罚等功能。经济补偿金的赔偿与惩罚功能不可取。设计经济补偿金制度时既要兼顾上述功能的轻重取舍,又要考虑到我国合同部门法以及相关部门法的原则、规定和制度体系。
“Labor Contract Law” and its supporting laws and regulations provide a large number of enterprises to pay the workers monetary compensation / compensation situation, pay the most financial compensation situation. Economic compensation benefits include default compensation, unemployment protection, corporate care, compensation and punishment functions. Compensation and punishment of economic compensation function is not desirable. When designing the system of economic compensation, it is necessary to take into account both the tradeoffs of the above functions and the principles, provisions and system of the law of the department of contract and relevant departments in our country.
