目的:了解劳动教养的现状及存在的问题,社区矫正的现状及存在的问题。对象:四川省各级公安机关以及社区矫正的试点城市。结论:现阶段的社会治安状况仍然十分严峻,违法犯罪十分突出;劳动教养是对《刑法》和《治安管理处罚法》的重要补充,弥补了前两种法律制度在预防和惩治违法犯罪方面的不足;社区矫正的推广适用应当审慎有序。
Objective: To understand the status quo and existing problems of reeducation through labor, status quo of community correction and existing problems. Objects: Public security agencies at all levels in Sichuan Province and pilot cities for community correction. Conclusion: The state of public order at this stage is still very grim, and crimes are extremely prominent. Reeducation through labor is an important complement to the Criminal Law and the Law on the Administration of Public Order and Security, and makes up for the two legal systems in preventing and punishing crimes Insufficient; the promotion of community correction should be prudent and orderly.
