完善法官员额制度是实现法官专业化不可缺少的前提条件,是一项具有重大而深远意义的改革和重大战略性举措,将会对人民法院的队伍建设,甚至国家的法治建设产生重大而深远的影响。基层法院是司法审判的基础,其运行状况直接决定我国法院体制的品质。然而,基层法院案多人少的矛盾日益突出,如何科学合理地配置法官人力资源成为法官员额制度的热点问题。法学理论工作者与实践部门的管理人员都对此进行了大量有益的探讨,对导致法官不足问题的原因进行了定性分析,但对区域内法官人力资源配置始终缺乏可行的定量分析。笔者试图运用定量分析的方法,对如何科学配置法官员额作探索,最大限度地提高人力资源的使用效益,以期为决策层优化法官人力资源配置提供有益参考。
Improving the system of judges’ posts is an indispensable precondition for realizing the professionalization of judges. It is a major and far-reaching reform and major strategic move that will have a significant and far-reaching impact on the contingent building of the people’s courts and even the rule of law in the country influences. Grassroots courts are the foundation of judicial proceedings, and their operational status directly determines the quality of the court system in our country. However, the conflicts among the grassroots courts are becoming increasingly prominent. How to allocate the human resources of judges scientificly and reasonably becomes a hot issue in the system of judge posts. Law theoreticians and managers of practice departments all conducted a great deal of useful discussions on this issue, which qualitatively analyzed the reasons that led to the problem of judges ’inadequacy. However, there was a lack of feasible quantitative analysis of the allocation of judges’ human resources in the region. The author tries to use quantitative analysis method to explore how to allocate judges ’posts scientifically so as to maximize the use efficiency of human resources so as to provide a useful reference for the decision makers to optimize the allocation of judges’ human resources.
