毕业生在就业过程中与用人单位签订就业协议以及劳动合同时,必然会碰到有关试用期的条款,而且一般来讲是必备条款。这些条款如果设定得好,可以有效保护毕业生的合法权益,但是如果毕业生对有关试用期的认识模棱两可的话,就很容易成为某些用人单位“设计陷害”的对象,钻入他们精心设计的“陷阱”当中去。特别是现在就业体制改革逐步深入、毕业生就业市场供大干求、就业形势日趋严峻的情况下,一些毕业生求职心切,又缺乏必要的法律知识,更会不明就里地上用人单位的当,使自己的合法权益受到损害。目前此类纠纷也呈不断上升的趋势。
