作为调整自由资本主义社会人身和财产关系的第一部完备的法律,《法国民法典》不仅是法兰西民族文化遗产中的瑰宝,更是世界法律史上一颗灿烂的明珠。在她诞生200周年之际,本刊约请中外著名私法和法律史学家撰文探讨其政治、经济背景和思想文化内涵,梳理其传播和流通轨道,总结其对今天之法治建设的有益经验。刊发这组文章不仅构成全球范围内的纪念《法国民法典》问世200周年庆典活动的一部分,而且对推动我国的比较法学研究、民法的制度建设也有所助益。
As the first complete law regulating the personal and property relations in a free capitalist society, the French Civil Code is not only a treasure in the national cultural heritage of France, but also a brilliant pearl in the history of world law. On the 200th anniversary of her birth, this journal invites Chinese and foreign famous private law and legal historians to write an essay on their political and economic background and ideological and cultural connotations, sort out their channels of communication and circulation, and summarize their useful experiences in the construction of the rule of law today. The publication of this group of articles not only forms part of a worldwide celebration of the 200th anniversary of the publication of the French Civil Code, but also helps to promote the comparative law study and the institutional construction of civil law in our country.
