作为当代国际航空运输立法的最新成果,1999年《蒙特利尔公约》开卷明义地在序言部分阐明了该公约的宗旨和原则之一即是“认识到确保国际航空运输消费者的利益的重要性,以及在恢复性赔偿原则的基础上提供公平赔偿的必要性。”由此正式明确了航空旅客作为消费者的法律地位,并将航空旅客消费者权益的保护作为公约的目标和宗旨之一予以确立。
As an up-to-date result of the contemporary legislation on international air transport, the Montreal Protocol of 1999 unveiled its memorandum in the preamble to clarify one of the purposes and principles of the Convention: “Recognizing the importance of ensuring the interests of consumers of international air transport As well as the need to provide fair compensation on the basis of the principle of restitution. ”This formally establishes the legal status of air travelers as consumers and takes the protection of the rights of consumers of air travelers as one of the objectives and purposes of the Convention Be established.
