房屋承租人优先购买权的适用范围不仅仅局限于出租人“出卖”房屋,在出租人“互易”、“代物清偿”、“以物抵债”、“法院执行拍卖或变卖”等情况下,房屋承租人依然应当享有优先购买权。但是,在出租人“法人破产、合并或分立”、“政策性分配房屋”、“合作开发建房”、“自拆联建房屋”、“混合赠与”等情况下,房屋承租人不应当享有优先购买权。承租部分房屋,但房屋整体出卖时,承租部分房屋的承租人的优先购买权则需要视情况具体分析。
