一、区、乡农民代表大会是区、乡农民协会的最高权力机关,在士地改革的准备与实行期间,代行区、乡人民代表大会的职权,为区、乡政权的最高权力机关。二、区、乡农代大会由区、乡农协委员会(或筹委会)召集,或联合区、乡人民政府召集之。三、凡年满十八岁之雇贫中农、其他劳动人民及贫苦知识分子,除患精神病及褫夺公权之犯罪分子外,均有权利选举或被选举为区、乡农代大会的代表。富农经区农协及区人民政府聘请,可为区农代大会代表。四、区、乡农代大会的代表名额依各区、乡人口多寡及居住聚散而定。乡代会代表总额大体以四十人(山地八百人口的小乡)至七十五人(平原三千人口的大乡)为标准。区代会代表总额大体以一百至一百五十人为标准。
