新的领导指挥体制下,建立军事法规为主体的军事法规制度体系将是今后军事立法实践的必然选择。然而,这并不只是一个实践问题,它也有着内在的理论逻辑。从理论前提看,军事立法权具有授权立法的性质,建立军事法规为主体的军事法规制度体系符合授权立法的本质要求;从目标功能看,建立军事法规为主体的军事法规制度体系有利于建构纵向的军事权力结构模式;从价值向度看,建立军事法规为主体的军事法规制度体系,有利于实现军事法的内在价值。
