2007年3月16日《中华人民共和国物权法》的正式颁布实施,使得“物权”一词开始深入人心。住宅小区的业主们虽然已经认识到了自己对小区共有部分享有所有权和使用权,但是由于他们对小区的“共有部分”界定不明晰,对物权法的相关条文也并不清楚,因此,关于住宅小区共有部分的权利冲突和纠纷大量存在着。本文旨在对现实生活中这些住宅小区权利问题的现状进行思考分析,并针对存在的问题发表了相关见解,提出了具有可行性的建议。
On March 16, 2007, the formal promulgation and implementation of the “Property Law of the People’s Republic of China” made the term “property rights” begin to penetrate the hearts of the people. Although the owners of residential quarters have realized that they have the ownership and the right to use the common part of the community, since the definition of the “common part” of the community is not clear and the relevant provisions of the Real Right Law are not clear, Community common part of the rights conflicts and disputes exist in large numbers. The purpose of this paper is to analyze and analyze the current situation of these residential quarters in real life. Relevant opinions on the existing problems are put forward and feasible suggestions are put forward.
