最高人民法院《关于审理商品房买卖合同纠纷案件适用法律若干问题的解释》(以下简称《解释》)第8条、第9条明确规定对开发商严重违反诚实信用原则,以及严重损害权利人利益的恶意违约、欺诈等行为适用惩罚性赔偿制度。《解释》实际上是《消费者权益保护法》(以下简称《消法》)惩罚性赔偿在商品房买卖领域的进一步细化,但目前商品房买卖直接适用《消法》的惩罚性赔偿还存在很大阻力。为此从实际出发,当前我们能做的就是完善《解释》的相关规定。通过完善赔偿标准,以实际损失为基础同时规定赔偿金的上限和下限,扩大惩罚性赔偿的适用条件和适用范围,确保惩罚性赔偿充分贯彻到商品房买卖领域中。
