10 月22日,公安部常务副部长田期玉在第十届全国人民代表大会常务委员会第十二次会议上作关于提请审议中华人民共和国治安管理处罚法草案(以下简称新草案)的议案的说明。当日开幕的十届全国人大常委会第十二次会议开始首次审议治安管理处罚法草案,这标志着备受各界关注的中国首部治安管理处罚法正式进入立法程序。 和已经实行了17年的现行治安管理处罚条例(以下简称原条例)相比,新草案作了重大的修改,一些群众反映强烈新出现的危害社会的问题纳入立法者的视线,原条例中一些不尽完善的规定得到了完善和补充,在执行程序上作了很大修改,与近年来新执行的行政法衔接得更紧密,体现出以人为本的精神,其中一些新亮点更是引人注目。
