《中华人民共和国涉外民事关系法律适用法》于2010年10月28日获得表决通过,并将自2011年4月1日起施行。该法用专门条款规定了知识产权的法律适用主要适用“被请求保护地”法律。“被请求保护地”是从公权力的角度对“权利请求保护地”的不同角度的另外一种说法。该规定接受了国际法律先进思想,充分保护了权利人的利益。
The Law of the People’s Republic of China on the Law Applicable to Foreign-related Civil Relations was passed on October 28, 2010 and will go into effect on April 1, 2011. The law provides for a special section of the law applicable to the main application of intellectual property “is required to protect ” law. The “protected area to be claimed” is another view from the perspective of public power on the different points of view of “protection of the rights claimed”. This provision has accepted the advanced thinking of international law and fully protected the interests of the rights holders.
