要想对民事诉讼中的法官释明权有一个充分的认知,其中很重要的一个方面就是要弄清楚其法律功能。以释明权基本含义的演变过程作为切入点进行深入分析,现代的释明权应该具有如下三个方面的功能,即:弥补辩论主义的缺陷,防止法官突袭裁判,促使既判力的正当化。
In order to have a full understanding of the judicial interpretations of civil litigation, one of the most important aspects is to make clear its legal function. To make an in-depth analysis of the evolution of the basic meaning of the right of interpretation as an entry point, the modern right of interpretation should have the following three functions: to remedy the defects of the debate and prevent the judges from raiding the referees and forcing the justification of the res judicata.
